They require clear evidence of wrongdoing and, just as importantly, catastrophic and irreversible harm. Based on our conversation with you, it did not appear that you were alleging catastrophic, irreversible injuries. Because of the extreme financial risks and high legal standards involved, we do not believe it is advisable for clients to pursue malpractice cases involving transient injuries. That said, this is just our opinion, and during our call, we specifically encouraged you to seek a second legal opinion from another firm.<br><br>We take great care in evaluating potential cases because we have a duty to protect clients from the significant costs and risks involved. Even strong cases can cost over $100,000 to litigate, and if a jury rules against the patient, they may be responsible for the doctor’s legal costs.<br><br>While we were not able to take on your matter, declining representation is never a reflection on the importance of your experience. We do understand it is frustrating that we were unable to accept your potential medical malpractice case. Medical malpractice cases are very costly to build, in part, because Colorado requires a similarly licensed medical expert to first sign off in support of a case and many doctors refuse to go on record against another doctor. We believe case selection is very important when pursuing medical negligence cases. Here there was no hospital stay, no irreversible damage, and no loss of limb or life alleged as an outcome. What was described to us did not meet the criteria we consider necessary to pursue a medical negligence case. During the call our team member was courteous and did her best to explain our decision.
