1. Acceptance of Terms

By accessing or using CrashStory ("the Service"), located at crashstory.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. CrashStory is operated by CrashStory ("we," "our," or "us") from Colorado, United States.

We reserve the right to update these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Description of Service

CrashStory is a crash data platform, attorney directory, and lead generation service that provides:

• Search and visualization of Colorado car accident data sourced from public records maintained by the Colorado Department of Transportation (CDOT).
• A directory of personal injury attorneys licensed in Colorado who have opted to be listed on our platform.
• Lead generation services that connect accident victims with attorneys based on location, case type, and specialty.
• Tools for submitting case details and receiving settlement value estimates.
• Educational content about car accidents, insurance claims, and legal processes in Colorado.

CrashStory is NOT a law firm and does NOT provide legal advice or legal services. All information on this site is for general informational purposes only and should not be construed as legal advice.

3. User Accounts

Certain features of the Service require you to create an account. When creating an account, you agree to:

• Be at least 18 years of age.
• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security of your account credentials and not share them with others.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are used for fraudulent activity, or are inactive for an extended period.

4. Attorney Directory

Our attorney directory lists lawyers who have opted to be included on our platform. Important disclosures:

• Not a referral service: CrashStory is not a lawyer referral service. We provide a directory and advertising platform for attorneys, not personalized recommendations or endorsements.
• Advertising disclosure: Attorney listings and profiles constitute attorney advertising under applicable rules of professional conduct. Attorneys pay for listing placement and lead access on our platform.
• No endorsement: The inclusion of an attorney in our directory does not imply any rating, endorsement, or recommendation by CrashStory. Past results of listed attorneys do not guarantee future outcomes.
• No attorney-client relationship: Your use of the directory or communication with a listed attorney through our platform does not create an attorney-client relationship. Such a relationship is only formed when the attorney agrees to represent you and you enter into a separate engagement agreement.

5. Lead Generation

CrashStory operates a lead generation service. By submitting your case information, requesting a consultation, or using our case evaluation tools, you understand and agree that:

• Your contact information (name, phone number, email address) and case details may be shared with one or more attorneys or law firms in our network.
• Attorneys may contact you regarding your case submission via phone, email, or other contact methods you provide.
• We do not guarantee that any attorney will accept your case, that you will receive a consultation, or that your case will achieve any particular outcome.
• Lead submissions may be subject to verification through third-party compliance services such as TrustedForm.
• You may opt out of receiving attorney communications at any time by contacting us.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we make no warranties regarding:

• The quality, competence, or suitability of any attorney listed on our platform.
• The outcome of any legal case or claim.
• The accuracy of settlement estimates or case evaluations.
• The accuracy, completeness, or timeliness of crash data from CDOT records.
• The uninterrupted or error-free operation of the Service.

7. Limitation of Liability

To the maximum extent permitted by law, CrashStory and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Damages resulting from reliance on information provided through the Service.
• Damages arising from the actions or omissions of attorneys listed on the platform.
• Loss of data, revenue, profit, or business opportunities.
• Service interruptions, data inaccuracies, or security breaches.
• Any conduct or content of any third party on the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid to us (if any) in the 12 months preceding the claim, or (b) one hundred dollars ($100).

8. TCPA Consent

By providing your phone number through any form on our Site, including case submission forms, consultation request forms, or account registration, you expressly consent to:

• Receive telephone calls, text messages (SMS/MMS), and pre-recorded or artificial voice messages from CrashStory and/or our attorney network partners at the phone number you provided.
• Such calls and messages may be made using an automatic telephone dialing system (autodialer) or prerecorded voice technology.
• Calls and messages may be for marketing purposes, lead follow-up, case status updates, or other service-related communications.
• Your consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency varies.

You may revoke your consent at any time by contacting us at david@crashstory.com or by replying STOP to any text message. Revoking consent will not affect any prior communications.

9. Intellectual Property

The CrashStory name, logo, website design, original content, software code, proprietary algorithms, data visualizations, and all other materials created by CrashStory are protected by copyright, trademark, and other intellectual property laws. CrashStory owns or licenses all intellectual property rights in the Service.

Public crash data sourced from CDOT is not owned by CrashStory. Our proprietary analysis, visualizations, commentary, and derivative works based on that data are owned by CrashStory.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit our proprietary content without prior written permission. Limited, non-commercial use of crash data for personal reference is permitted.

10. User Content

You may submit content to our platform, including attorney reviews, crash reports, case details, and other user-generated content ("User Content"). By submitting User Content, you:

• Grant CrashStory a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with the Service.
• Represent and warrant that you own or have the right to submit the User Content and that it does not violate any third-party rights.
• Agree that your User Content will not contain false, misleading, defamatory, or illegal material.
• Acknowledge that we may moderate, edit, or remove User Content at our discretion, including content that violates these Terms or is reported as inappropriate.

Reviews submitted about attorneys reflect the opinions of individual users and do not represent the views or endorsement of CrashStory.

11. Indemnification

You agree to indemnify, defend, and hold harmless CrashStory, its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your User Content.
• Your violation of any third-party rights.
• Any misrepresentation made by you.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service that are not subject to arbitration (as described below) shall be resolved exclusively in the state or federal courts located in Denver County, Colorado. You consent to the personal jurisdiction of such courts.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and CrashStory agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if eligible.

• Arbitration rules: Arbitration will be conducted under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitration will take place in Denver, Colorado, or at another mutually agreed location.
• No class actions: You and CrashStory each agree that any Dispute will be resolved only on an individual basis and not as a class action, collective action, or representative action. The arbitrator may not consolidate more than one person's claims.
• Opt-out: You may opt out of this arbitration provision by sending written notice to david@crashstory.com within 30 days of first accepting these Terms.
• Exceptions: This arbitration clause does not apply to claims for injunctive or equitable relief, intellectual property disputes, or claims that are eligible for small claims court.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and arbitration) will survive.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. For material changes, we may also notify registered users via email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
